NORTH ADAMS -- A school administrator suspected of using and selling prescription opiates on Cheshire Elementary School grounds was arraigned in Northern Berkshire District Court Wednesday on a possession of a Class B drug charge.

Kurt Garivaltis, 45, of East Road in Adams, was arrested on Jan. 24 by members of the Berkshire County Drug Task Force (BCDTF) outside the school. Garivaltis is director of special services for Adams-Cheshire Regional School District. Superintendent Kristen Gordon said late last month his employment status is under review.

Acting on information they'd received earlier in the month, BCDTF searched Garivaltis' briefcase, car and office, on Jan. 24, allegedly turning up one 30 mg Percocet pill and box of Fentanyl patches.

Garivaltis' attorney Leonard H. Cohen has filed a motion for the court to unseal the search warrant that led to his client's arrest, according to court documents.

In a document dated Feb. 4, Cohen writes "to deny the defendant the search warrant and affidavit under these circumstances constitutes a violation of due process of both Federal and State constitutions."

A brief written statement from Judge Laurie MacLeod said no action has been taken on Cohen's motion and the warrant is currently impounded until March 25, 2013.

A pretrial date has been scheduled for March 19.
