NORTH ADAMS -- The Berkshire County District Attorney's office has requested the medical records for the driver involved in tractor trailer accident at Dead Man's Curve on Route 2 in Florida.
Clement S. Leslie, 51, of Vineland, N.J., is facing charges of negligent operation of a motor vehicle, speeding and a marked lanes violation for the accident that occurred on April 10.
A motion, filed by the Assistant District Attorney Laila L. Atta on Wednesday, states the Commonwealth will use the records prior to pretrial on Oct. 23 to determine if a drug screen was conducted.
"If such a screening exists, the Commonwealth will use this both as evidence of negligent operation, as well as to possibly bring charges of drugs," it states.
Emergency personnel responded to the infamous s-turn one mile east of South County Road shortly before 5 p.m. to find Leslie trapped inside the truck cabin.
According to the report, written by State Trooper David G. McKearney, Leslie told police he was going "real slow down the hill" when "all of a sudden, I was in the turn and going faster than I should have been for the turn."
The report states an Emergency Medical Technician advised state police that Leslie may have been under the influence of drugs, as he had constricted pupils and no sign of severe head trauma.
An EMT also advised state police that members of the Florida Fire Department stated Leslie "had his pants down to his knees when they had found him under the truck."
The report also notes a pornographic magazine found in the interior next to the driver's seat.
McKearney states in the report that he and the EMT "discussed the presence of the pornographic magazine nearby and then both formed the opinion that Leslie may have been masturbating while he was driving."
Leslie was also found to be in violation of a Federal Motor Carrier Safety Administration -- he had been driving for 14 and a half hours.
State police sent an immediate threat request to the Massachusetts Registry of Motor Vehicles, which suspended Leslie's commercial drivers license.
