ADAMS - A man accused of assault and battery on a person over 60 years of age was found not guilty by a jury at Northern Berkshire District Court Thursday.
Homer Tanguay alleged his neighbor, Philip Larabee Jr., 49, of East Road, Adams, assaulted him last December by using a snowblower to propel snow into his chest and face.
Tanguay told police Larabee then punched him in the face, knocking him to the ground.
According to the police report, Tanguay said that Larabee had been blowing snow from his property on to Tanguay's, including onto his vehicles.
Larabee assaulted him, Tanguay alleged, after he confronted Larabee about the snow.
Jury deliberations lasted more than two hours.
Shortly before its decision the jury submitted a written question to the presiding judge asking if intentionally hitting a person with snow from a snowblower is considered assault. The judge replied that the snow should not be considered as a basis for conviction.
